The capacity to contract marriage varies from person to person depending upon his/her personal circumstances. Foreign nationals desiring to contract marriage abroad are normally required to submit documents that show his/her civil status in order to satisfy the requirements of the foreign government that the person seeking to wed another individual in the jurisdiction of the foreign government has the legal capacity to do so.
For Filipinos living in Indonesia being asked by local authorities to show proof of civil status that capacitates him/her to marry, the Consular Section of the Philippine Consulate General can legalize (notarize) a sworn declaration personally executed by the person concerned about his/her marital status, showing valid and corresponding evidence to support his/her claim as follows:
To support declaration of civil status as SINGLE:
- Original unexpired Philippine passport and clear copy of biographic data page.
- Original DFA-Apostilled PSA-issued Certificate of Live Birth and clear photo copy.
- Original DFA-Apostilled PSA-issued Certificate of No Records of Marriage (CENOMAR)* and clear photo copy.
* The certification of PSA that the individual concerned has no record of marriage does not have an expiry date. However, as the fact being certified can change over time, the CENOMAR should be submitted as a support document to the Consular Section within six (6) months of its issuance which is considered a reasonable period within which the bearer has plausibly not changed his civil status.
To support declaration of civil status as WIDOW / WIDOWER:
- Original unexpired Philippine passport and clear copy of biographic data page.
- Original DFA-Apostilled PSA-issued Marriage Certificate and clear photo copy.
- Original DFA-Apostilled PSA-issued Death Certificate of deceased spouse and clear photo copy, or foreign-issued proof of death (with English translation as applicable) duly authenticated / apostilled.
To support declaration of civil status as ANNULLED / DIVORCED:
- Original unexpired Philippine passport and clear copy of biographic data page.
- Original DFA-Apostilled PSA-issued Marriage Certificate with annotation on annulment or divorce (whichever is applicable) and clear photo copy.
- If through annulment, original DFA-Apostilled Court Order and Certificate of Finality dissolving the previous marriage and a clear photo copy. If through divorce, original DFA-Apostilled Philippine Court Order recognizing the foreign divorce judgment or decree and capacitating both spouses to remarry, and a clear photo copy.
REQUIREMENTS:

2. Original and photocopy of Certificate of No Record of Marriage (CENOMAR) issued by the Philippine Statistics Authority (PSA) and duly apostilled by DFA;
3. Original and photocopy of Birth Certificate issued by the Philippine Statistics Authority (PSA) and duly apostilled by DFA;
4. Original and photocopy of Passport of the Filipino citizen
5. Photocopy of Passport/KTP of the foreign partner
6. Photocopy of birth certificate of the foreign partner (with English translation if not written in English or not bilingual)
7. 2 x 2 in inches individual photo taken against white background of the couple
ADDITIONAL REQUIREMENTS:
- For applicants 18 years old but below 21, submit original Affidavit of parental consent.
- For applicants aged from 21 to 25 years old, submit original affidavit of Parental Advice
FOR APPLICANTS PREVIOUSLY MARRIED AND OBTAINED ANNULMENT:
- Original and photocopy of the Marriage Certificate duly annotated issued by the PSA and apostilled by the DFA;
- Certified true copy of the Court decision declaring the marriage annulled or divorce decree
FOR WIDOWED APPLICANTS:
- Original and photocopy of the Marriage Certificate issued by the PSA and authenticated by the DFA;
- Original and photocopy of the PSA and authenticated by the DFA, if death occurred in the Philippines
- If death occurred outside of the Philippines, original and photocopy of the death certificate duly authenticated by the Embassy or Philippine Consulate General having jurisdiction over the place where the said death occurred.
Certification fee: IDR 455,000
Processing (Posting/publication): 10 consecutive days
Validity of Certification: 120 calendar days
NOTE: The application form should be notarized. If notarized by an Indonesian notary public, the accomplished application form should be authenticated by the two (2) Ministries in Indonesia (Ministry of Law and Human Rights and Ministry of Foreign Affairs).
If the applicant wishes to have the application form notarized at the Consular Section of the Philippine Consulate General, personal appearance of the applicant and a notarial fee of IDR 455,000 are required.
